1.The child is in immediate danger because the mother has threatened to further abuse, traumatize and manipulate the child to create new false justifications to keep jurisdiction in west va
2.The Child and Father’s Civil and WV Parents Bill of Rights have been violated by the Proceedings in West Va starting Sept 26 violating UCCJEA and other Federal Statutes. Their actions are intentionally causing harm to both and causing the child to lose her freedom and shutting off all access to anyone for her to speak to about her abuse.
3.West VA CPS not only refuses to investigate sexual and other abuse allegations and ignores referrals from concerned citizens, their own law enforcement , MD CPS and MD court ordered investigations.
4.West Va CPS violate their own policies and procedures by refusing to interview the child for sexual and other abuse and put less than an hour of effort for the referrals for 1 day while spending 100s of hours helping the mother over 9 months and are helping her violate the terms of a protective order.(phone records)
- West Va CPS is not only refusing to assist but are actively suppressing evidence, interfering and obstructing with multiple criminal investigations in multiple jurisdictions against the mother.
6.West Va is intentionally and maliciously pursuing a case with zero evidence of jurisdiction or commission of any abuse. They are ignoring, suppressing and denying evidence presented that proves this falsehood. (i.e accusing a paralyzed person of an act they are incapable of performing). They are also falsely claiming MD has vacated jurisdiction and suppressing that they ceded jurisdiction and contributed to the 5/30 MD trial.
7.West Va CPS is falsely claiming in BC Circuit Court that MD has vacated jurisdiction on their protective order. Judge Bonifant, Chief Administrative Judge of Montgomery County is eager to hear from West Virginia why they feel they have jurisdiction. Already the mother’s attorney is using the illegal actions since April to claim jurisdiction. Violating court orders to kidnap a child and holding her hostage for 6 months using fraudulent information isn’t lawful justification. Also this petition was submitted on July 8. It was purposefully and cruelly filed on Sept 26 with the intent to prevent visitation for the holidays without any due process.
